1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Web Guardian LTD ("Company", "we", "us", or "our"), governing your access to and use of the WebGuardian platform, including our website at webguardian.io and all related services (collectively, the "Service").

By creating an account or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

WebGuardian provides a monitoring and security platform that includes:

  • Uptime and availability monitoring for websites, APIs, and servers
  • Security vulnerability scanning and CVE tracking
  • SSL certificate monitoring and expiry alerts
  • Multi-channel alerting (email, SMS, Discord, Slack, webhooks)
  • Public and private status pages
  • Team collaboration and management features
  • Automated remediation capabilities

3. Account Registration

To use certain features of the Service, you must create an account. When registering, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized access

You must be at least 16 years old to create an account. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscription and Payments

4.1 Free Trial

We offer a 6-month free trial for new users. No credit card is required to start your trial. At the end of the trial period, you may choose to subscribe to a paid plan to continue using the Service.

4.2 Paid Subscriptions

Paid subscriptions are billed in advance on a monthly or annual basis. All payments are processed securely through Stripe. By subscribing, you authorize us to charge your payment method for recurring fees.

4.3 Refunds

We offer refunds on a case-by-case basis. If you are unsatisfied with the Service within the first 14 days of a paid subscription, contact us to discuss a refund.

4.4 Price Changes

We may change our prices with 30 days' notice. Price changes will take effect at the start of your next billing period.

5. SMS Notifications

If you opt-in to receive SMS notifications:

  • You consent to receive automated text messages regarding service alerts, security notifications, and account updates
  • Message frequency varies based on your alert configuration and monitored services
  • Message and data rates may apply based on your mobile carrier plan
  • You can opt-out at any time by replying STOP to any message
  • For help, reply HELP to any message or contact support

SMS notifications are provided as a convenience and should not be relied upon as the sole means of receiving critical alerts. We recommend configuring multiple notification channels.

6. Acceptable Use

You agree not to use the Service to:

  • Monitor systems, websites, or services you do not own or have authorization to monitor
  • Conduct denial-of-service attacks or flood systems with excessive requests
  • Attempt to gain unauthorized access to any systems or networks
  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights of others
  • Transmit malware, viruses, or malicious code
  • Harass, abuse, or harm others
  • Impersonate any person or entity
  • Interfere with or disrupt the Service
  • Resell or redistribute the Service without authorization

7. Monitoring Authorization

By adding URLs, IP addresses, or endpoints to the Service, you represent and warrant that:

  • You own the monitored resources or have explicit authorization to monitor them
  • Your use complies with all applicable terms of service and policies of the monitored systems
  • You will not use the Service to monitor third-party systems without proper consent

We reserve the right to suspend monitoring of any resource if we believe it violates these Terms or applicable law.

8. Intellectual Property

The Service, including all content, features, and functionality, is owned by Web Guardian LTD and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.

You retain ownership of any data you submit to the Service. By using the Service, you grant us a limited license to use, process, and store your data solely for the purpose of providing the Service.

9. Service Availability and SLA

We strive to maintain 99.9% uptime for the Service. However, we do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable for maintenance, updates, or circumstances beyond our control.

For enterprise customers, specific service level agreements (SLAs) may be established in separate written agreements.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND
  • WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
  • WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM

The Service is a monitoring tool designed to help detect issues. We do not guarantee that all issues will be detected or that alerts will be delivered without delay. You acknowledge that the Service should be used as part of a comprehensive monitoring strategy.

11. Indemnification

You agree to indemnify and hold harmless Web Guardian LTD, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any unauthorized monitoring activities

12. Termination

You may terminate your account at any time through your account settings or by contacting us. We may suspend or terminate your account if:

  • You violate these Terms
  • We are required to do so by law
  • Your account has been inactive for an extended period
  • We discontinue the Service

Upon termination, your right to use the Service ceases immediately. We may retain your data for a limited period in accordance with our Privacy Policy.

13. Modifications to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

14. Governing Law and Disputes

These Terms are governed by the laws of Bulgaria, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts in Sofia, Bulgaria.

For EU consumers, this does not affect your statutory rights under applicable consumer protection laws.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Web Guardian LTD regarding the Service and supersede all prior agreements and understandings.
